Apple’s Irish tax escrow account has lost almost a billion dollars in the last year

The amount available at the end of the day for either Apple or the Irish government from lengthy legal proceedings over the company’s Irish tax affairs lost almost a billion dollars in the last year ahead of the final ruling. If the EU wins, the sum will be handed over to the Irish government; if the EU loses, it will be returned to Apple.

The Irish Times:

A quick recap: the State set up the escrow account in 2018 to hold €14.3 billion of alleged back taxes and interest that the European Commission ordered it to collect from Apple, even as the State and the iPhone maker appealed the matter before the courts in Luxembourg.

Apple and the Government won their case in 2020, with the General Court in Luxembourg deciding that the commission failed to show to “the requisite legal standard” that the US tech giant secured an unfair tax advantage in the decade to 2014.

A hearing on the commission’s appeal against that decision was heard by the European Court of Justice last month, with the court’s advocate general set to deliver his influential opinion on November 9th – ahead of a final ruling.

The escrow account is mainly made up of investments in euro-zone government bonds, rather than cash. The Department of Finance said on Wednesday that a further €259 million was knocked off the fund’s value last year, to bring it down to less than €13.4 billion.

Apple opposes UK bill that could mandate backdoor scanning in iMessage

Apple is the Online Safety Bill as it could be used to force encrypted messaging tools like iMessage, WhatsApp, Signal and other to scan messages for, ostensibly, child sexual abuse material (CSAM). Apple’s opposition comes as 80 organizations and tech experts have written to UK Technology Minister Chloe Smith urging a rethink.

Apple told the BBC the bill should be amended to protect encryption.

Police, the government and some high-profile child protection charities maintain the tech – used in apps such as WhatsApp and Apple’s iMessage – prevents law enforcement and the firms themselves from identifying the sharing of child sexual abuse material.

But in a statement Apple said: “End-to-end encryption is a critical capability that protects the privacy of journalists, human rights activists, and diplomats.
“It also helps everyday citizens defend themselves from surveillance, identity theft, fraud, and data breaches. The Online Safety Bill poses a serious threat to this protection, and could put UK citizens at greater risk.

“Apple urges the government to amend the bill to protect strong end-to-end encryption for the benefit of all.”

Several messaging platforms, including Signal and WhatsApp, have previously told the BBC they will refuse to weaken the privacy of their encrypted messaging systems if directed to do so.

Signal said in February that it would “walk” from the UK if forced to weaken the privacy of its encrypted messaging app.

Apple’s statement now means that some of the most widely used encrypted apps oppose this part of the bill.

In 2021 Apple announced plans to scan photographs on people’s iPhones for abusive content before they were uploaded to iCloud but these were abandoned after a backlash. It has now clearly signalled its opposition to any measure that weakens the privacy of end-to-end encryption.

Dear Ms Smith,

Online Safety Bill: Civil society organisations urge UK to protect global digital security and safeguard private communication.

We are over 80 national and international civil society organisations, academics and cyber- experts. We represent a wide range of perspectives including digital human rights and technology. We are writing to you to raise our concerns about the serious threat to the security of private and encrypted messaging posed by the UK’s proposed Online Safety Bill (OSB).

The Online Safety Bill is a deeply troubling legislative proposal. If passed in its present form, the UK could become the first liberal democracy to require the routine scanning of people’s private chat messages, including chats that are secured by end-to-end encryption. As over 40 million UK citizens and 2 billion people worldwide rely on these services, this poses a significant risk to the security of digital communication services not only in the UK, but also internationally.

End-to-end encryption ensures the security of communications for everyone on a network.

It is designed so that no-one, including the platform provider, can read or alter the messages. The confidentiality between sender and recipient is completely preserved. That’s why the United Nations, several human rights groups, and anti-human trafficking organisations alike have emphasised that encryption is a vital human rights tool. [i]

In order to comply with the Online Safety Bill, platform providers would have to break that protection either by removing it or by developing work-arounds. Any form of work-around risks compromising the security of the messaging platform, creating back-doors, and other dangerous ways and means for malicious actors and hostile states to corrupt the system. [ii] This would put all users in danger.

The UK government has indicated its intention for providers to use a technology that would scan chats on people’s phone and devices – known as client-side scanning. The UK government’s assertion that client-side scanning will not compromise the privacy of messages contradicts the significant evidence of cyber-security experts around the world. This software intercepts chat messages before they are encrypted, and as the user is uploading their images or text, and therefore confidentiality of messages cannot be guaranteed. It would most likely breach human rights law in the UK and internationally. [iii]

Serious concerns have also been raised about similar provisions in the EU’s proposed ‘Child Sexual Abuse Regulation’, which an independent expert study warns is in contradiction to human rights rules. [iv] French, Irish and Austrian parliamentarians have all also warned of severe threats to human rights and of undermining encryption. [v]

Moreover, the scanning software would have to be pre-installed on people’s phones, without their permission or full awareness of the severe privacy and security implications. The underlying databases can be corrupted by hostile actors, meaning that individual phones would become vulnerable to attack. The breadth of the measures proposed in the Online Safety Bill – which would infringe the rights to privacy to the same extent for the internet’s majority of legitimate law-abiding users as it would for potential criminals – means that the measures cannot be considered either necessary or proportionate. [vi]

The inconvenient truth is that it is not possible to scan messages for bad things without infringing on the privacy of lawful messages. It is not possible to create a backdoor that only works for “good people” and that cannot be exploited by “bad people”.

Privacy and free expression rights are vital for all citizens everywhere, in every country, to do their jobs, raise their voices, and hold power to account without arbitrary intrusion, persecution or repression. End-to-end encryption provides vital security that allows them to do that without arbitrary interference. People in conflict zones who rely on secure encrypted communications to be able to speak safely to friends and family as well as for national security. Journalists around the world who rely on the confidential channels of encrypted chat, can communicate to sources and upload their stories in safety.

Children, too, need these rights, as emphasised by UNICEF based on the UN Convention of the Rights of the Child.vii Child safety and privacy are not mutually exclusive; they are mutually reinforcing. Indeed, children are less safe without encrypted communications, as they equally rely on secure digital experiences free from their data being harvested or conversations intercepted. Online content scanning alone cannot hope to find out the serious cases of exploitation, which require a whole-of-society approach. The UK government must invest in education, judicial reform, social services, law enforcement and other critical resources to prevent abuse before it can reach the point of online dissemination, thereby prioritising harm prevention over retrospective scanning. [viii]

As an international community, we are deeply concerned that the UK will become the weak link in the global system. The security risk will not be confined within UK borders. It is difficult to envisage how such a destructive step for the security of billions of users could be justified. [ix]

The UK Prime Minister, Rishi Sunak, has said that the UK will maintain freedom, peace and security around the world. With that in mind, we urge you to ensure that end-to-end encrypted services will be removed from the scope of the Bill and that the privacy of people’s confidential communications will be upheld.

California hiker saved thanks to Emergency SOS via satellite on her iPhone 14

A woman hiking in Trail Canyon Falls in the Angelos National Forest in California has been saved thanks to Apple’s Emergency SOS via satellite service on her iPhone 14.

A woman who suffered a broken leg while hiking in Tujunga was able to call 911 despite not having cell phone service due to a new and innovative feature on the iPhone 14.

Juana Reyes was hiking with friends in a remote part of Trail Canyon Falls in the Angelos National Forest when the trail collapsed underneath her.

“We tried to get a hold of 911 but there was no service on our phones,” said Reyes in an interview with Eyewitness News. “Thankfully, my phone has that SOS satellite feature that was able to connect to… I’m assuming satellites.”

The feature Reyes is referring to is the iPhone 14’s “Emergency SOS via satellite” feature.

As the name suggests, you can use the feature to text emergency services when you’re out of cell and Wi-Fi coverage. You can also use the Find My app to share your location via satellite.

iPhone 14’s Emergency SOS via Satellite Feature Saves California Hiker

Emergency SOS via Satellite, a feature introduced with the iPhone 14 models, over the weekend saved a hiker who was injured on a trail. As reported by ABC7, Juana Reyes was hiking a remote part of the Trail Canyon Falls in the Angeles National Forest when she suffered an accident.

A part of the trail collapsed underneath her, breaking her leg. She had no cellular service, nor did the people who were with her, but she did have an ‌iPhone 14‌. “Thankfully, my phone has that SOS satellite feature I was able to connect to… I’m assuming satellites,” she said.

The Los Angeles County Fire Department Air Operations Section was able to get to Reyes after receiving a satellite call. She was successfully air lifted to safety using a helicopter.

According to the Los Angeles County Sheriff’s Department, three iPhone rescues have been conducted over the course of the year, one of which was in the same general area. Last December, a vehicle went over the side of a mountain on the Angeles Forest Highway in the Angeles National Forest, with Crash Detection and Emergency SOS via Satellite used to contact rescuers.

Emergency Satellite via SOS is available to all ‌‌‌iPhone 14‌‌‌ users, and it can be activated when an emergency situation occurs and there is no WiFi or cellular connection available. Emergency SOS via Satellite works in the United States, Canada, France, Germany, Ireland, and the UK.

Apple to replace closed Northlake Mall store with Birkdale Village store in North Carolina

Apple in March permanently shut down its retail stores in Charlotte, North Carolina, after the mall where it’s located suffered at least three shootings in recent months. At the time, Apple’s website stated, “In preparation for a new store we plan to open in the Charlotte area early next year, we will be permanently closing Wednesday, March 1st at 4pm.”

Tech giant Apple Inc. is bringing a retail store to Huntersville’s Birkdale Village.

The town’s planning department confirmed today that a permit for an Apple Store there has been filed and approved. The Birkdale Village location stands to replace the Apple Store that abruptly shuttered at Northlake Mall earlier this year.

Construction has kicked off on the project at 8805 Townley Road — formerly home to Girl Supply and Pier One Imports. Mecklenburg County permits show the project is valued at $8.6 million.

Birkdale Village owner North American Properties is listed as the owner on the permit, which describes only retail store improvements. Roughly 9,800 square feet is to be renovated, with landlord improvements to prepare the space for a new tenant layout and modification of the exterior. The tenant scope of work will include improvement of the existing leased space with non-structural partitions, ceilings, finishes, furniture and related infrastructure work.

MacDailyNews Take: At the time of the Charlotte-area closings, Apple told employees that there will be no layoffs and that staff at the Northlake Mall site would be transferred to the nearby SouthPark location in Charlotte or roles working at the company’s online store.

Bloomberg News‘ Mark Gurman reported in March that the company would be opening a new location in Charlotte in 2024 to replace the Northlake Mall store. Plans for that store were already in the works before the recent shootings, Gurman reported.

Nomad’s new MagSafe-compatible Stand and Base charge slower but cost less

Want a fancy-looking charger for your MagSafe-compatible iPhone but don’t want to pay such a hefty premium price? Nomad is offering a new pair of chargers that do just that, and the key is cutting out Apple’s true MagSafe compatibility and its required Made for iPhone tax.

The $70 Nomad Base and $80 Nomad Stand launching today are nearly identical to the existing Base One and Stand One, but unlike those models, these new chargers are not officially “Made for MagSafe.” Instead, they are simply wireless Qi with magnets for alignment, and they top out at 7.5W rather than the 15W of true MagSafe, but the compromise on charging speed is made for the sake of your wallet.

The Nomad Base keeps your phone flat but also allows for other non-magnetic Qi devices to be charged.

Physically, the new Base and Stand chargers are the spitting image of their pricier MagSafe counterparts, except the white models are now all white (not silver and white) and the black models have a blacked-out charging pad instead of the contrasting white found on true MagSafe chargers. Does it matter in use? Not at all, but if you’re paying Nomad money, then you want top-notch fit and finish — and these black-on-black obelisks look great. It’s a fairly minor thing, but the black Base and Stand look much sleeker this way, and after trying both of them out for a short while, I prefer them to their MagSafe-equipped “One” versions.

Just about everything else from the new Stand One and Base One is here now in the new Stand and Base, including the same CNC-machined aluminum and glass build, the built-in two-meter / 6.6-foot USB-C cable (which I still wish were detachable), and the lack of an included USB-C power adapter. (You once again must provide your own with minimum 20W output.) But the $30 discount on these is substantial enough that I can forgive their single-use purpose and lean more toward enjoying them for their fine build quality and construction.

When you’re paying $100 or $110, it’s hard to ignore that these single-device chargers get close to the price of two-in-one and three-in-one alternatives. While, at $80 and $70, these new chargers still are not cheap, they don’t seem quite as much of a reckless expenditure — especially since the regular act of charging your phone overnight doesn’t really require 15W MagSafe speeds.

Some Apple Savings account customers see delayed withdrawals from Goldman Sachs

Apple’s high-yield savings account, a partnership with Goldman Sachs, launched in April. Some customers have endured longer than expected waits for withdrawals and transfers to complete.

Apple Card users can choose to grow their Daily Cash rewards by automatically depositing their Daily Cash into a high-yield Savings account from Goldman Sachs.

Nathan Thacker, who lives outside Atlanta, had been trying to transfer $1,700 from his Apple account to JPMorgan Chase since May 15. Each time he called Goldman’s customer service department, he said, he was told to give it a few more days.

The money arrived in his Chase account Thursday morning, he said, after The Wall Street Journal contacted Goldman about his and other customers’ experiences.

Others said they also had trouble transferring money from their new Apple accounts. Customer service representatives at Goldman, which holds the deposits, sometimes gave differing responses about what to do, they said…

“The customer response to the new savings account for Apple Card users has been excellent and beyond our expectations,” the bank said in a statement. “While the vast majority of customers see no delays in transferring their funds, in a limited number of cases, a user may experience a delayed transfer due to processes in place designed to help protect their accounts.”

On brand-new accounts, like Apple’s, transfers that make up a large share of the overall balance can trigger anti–money-laundering alerts or other security concerns that require additional review, according to people in the AML [Anti-Money Laundering] field. Those delays usually last five or so days, they said.
